Вы цитируете договор между Великобританией и США. Существует ли что-нибудь подобное между Великобританией и Россией?
Да и в этом договоре прямо говорится: "Extradition shall not be granted if the offense for which extradition is requested is a political offense."
Закаев - не ординарный убийца или бандит, поэтому его бы и в США не выдали.

Здесь речь идет о том, что в США исполнительная ветвь власти определяет невозможность выдачи. Обратите внимание, что возможность выдачи - не в ее компетенции.

А что тут такого? Каждая страна имеет разные законы, поэтому то, что считается преступлением в одной из них может не считаться преступлением в другой.

А причем тут принцип разделения властей?

Конечно, без него нельзя, это же основополагающий принцип. И опять же, исполнительные власти могут только отказать в выдаче, но права на выдачу у них нет.
