Article 38
The Court shall apply:
1. International conventions, whether general or particular, establishing rules expressly recognized by the contesting States;
2. International custom, as evidence of a general practice accepted as law;
3. The general principles of law recognized by civilized nations;
4. Subject to the provisions of Article 59, judicial decisions and the teachings of the most highly qualified publicists of the various nations, as subsidiary means for the determination of rules of law. This provision shall not prejudice the power of the Court to decide a case ex aequo et bono, if the parties agree thereto.

Значит говорите не имеет к данности отношения? Нацисты тоже так думали и на суде заявляли, что обычаи в ним не относятся. Но трибунал указал, что
...In the third "legal" section, the IMT disposed of the contention that the defendants could not be held to compliance with the laws of war as set forth in the Hague and Geneva conventions because several of the belligerents in the second World War (notably the Soviet Union) were not parties to these conventions. This argument, said the court, overlooked the fact that the conventions were merely declaratory of preexisting and well-established laws of war "recognized by all civilized nations," and that the laws of war are binding on all, irrespective of whether a particular government has signed a particular convention.

Я живу в мире в котором Нюрнбергский трибунал указал, что установившиеся международные обычаи и законы требуется соблюдать вне зависимости от тог оподписала ли страна конвенцию или нет. Именно поэтому Мума-Юмба или Либерия могут что угодно подписывать с США, в разрезе международного права это не имеет ровным счетом никакого значения.
